Bar Council of India seeks details on ex-CM’s practice status from West Bengal bar council
“Mrs Mamata Banerjee Served as Chief Minister of West Bengal from 2011 to 2026. Having regard to the constitutional public office held by him during the said period, and without at this stage expressing any opinion as to the permissibility or otherwise of such attendance, the Bar Council of India requires information as to the actual status of his enrollment, practice, suspension, if any, and reinstatement, “If your B.It listed 9 pointers for the State Bar Council by May 16, 2016. Details were asked i His enrollment number if enrolled with West Bengal State Bar Council. ii. Date of his enrollment in the State Bar Council of West Bengal. iii. Whether his name continues in the State Roll of Advocates currently maintained by the West Bengal State Bar Council. iv Whether he has, at any time during his tenure as Chief Minister of West Bengal, given any indication of voluntary suspension/suspension from practice/cease from practice. v. If any such intimation is given, the date on which it was received by the State Bar Council, along with a copy of the relevant application/initiation and order/noting, if any. vi Whether any application / notification for resumption of practice was thereafter submitted by him. vii If so, the date of such application / commencement for resumption of practice, and whether it has been accepted / taken on record by the State Bar Council. viii. Whether any certificate of practice / relevant practice-status record on his behalf is available with the State Bar Council and is currently valid, active, suspended or otherwise. ix Whether there exists any other record, information, communication, order or entry relating to his entitlement to exercise during or after his tenure as Chief Minister.The Bar Council of India has also directed that the information provided must be strictly based on “contemporaneous official records” maintained by the West Bengal State Bar Council, including enrollment registers, state roll records, certificate of practice documents, internal registers, records relating to suspension or discontinuance of practice, reinstatement orders or reinstatement record files. It is sought certified copies of all relevant documents, duly attested by the Secretary of the State Bar Council, with page reference, date of entry, internal diary number and custody details of the original record. The BCI has asked the State Bar Council to furnish certified copies of all supporting documents relating to enrolment, suspension, discontinuance or resumption of practice, correspondence files, internal registers and any other relevant records available with it. Further, the Secretary is directed to certify that the copies submitted are “true copies of the original records maintained in the ordinary course of government business” and that the original documents have been preserved for inspection when necessary. Pending the submission of the reply, the BCI further ordered that all original records relating to the matter be preserved “in their present form” and no “alteration, correction, overwriting, interpolation or reconstruction” shall be made in accordance with law and after informing the Bar Council of India. The State Bar Council has been asked to respond within two days of receiving the letter.
Mamata in lawyer’s clothes
Mamata Banerjee appeared at the Calcutta High Court on Thursday in full lawyer’s garb, a black lawyer’s coat and her trademark white sari with a blue border and white band, to argue a public interest case related to post-poll violence in the state following the recently concluded assembly elections.He appeared before a division bench of Chief Justice Sujoy Paul and Justice Partha Sarathi Sen and presented the alleged photographs and a list of those killed in the violence. During the hearing, he urged the court to “protect the people of Bengal” and accused the authorities of failing to take action against attacks, looting and alleged intimidation in various parts of the state.His appearance in the High Court triggered loud chanting inside the court premises and the subsequent rise in political tension.
