Denial of interim stay in ‘Dhurandhar 2’ song controversy: High Court directs Super Cassettes to deposit Rs 50 lakh in 4 weeks




The Delhi High Court on Thursday refused to grant interim relief to Trimurti Films in the copyright dispute between Trimurti Films and the producers of the film ‘Dhurandhar 2’. The matter is related to the song ‘Tirchi Topiwale (Oye Oye)’. Trimurti Films had demanded to stop the OTT release of ‘Dhurandhar 2’. Which the court refused to stop. However, Justice Tushar Rao Gedela directed Super Cassettes to deposit Rs 50 lakh in the court within four weeks. The complainant in the case is Trimurti Films (Rajeev Rai) and the defendants include Super Cassettes (T-Series) and B62 Studios. Let us tell you that Super Cassettes Industries Private Limited is known as T-Series all over the world. The court said that at this time it is not possible to give an interim order as demanded by the plaintiff, but it would be right to demand a deposit to secure the claim of Trimurti Films. According to Bar & Bench report, the court directed that this amount be deposited in the name of the Registrar General and kept in auto-renewal. The successful party will get the benefit at the end of the trial. The detailed copy of the order has not been released yet. What is the whole matter? Production company Trimurti Films had filed a copyright infringement case against filmmaker Aditya Dhar’s production house B62 Studios. The company’s allegation was that the famous song ‘Tirchi Topiwale (Oye Oye)’ and its similar tune from the 1989 film ‘Tridev’ was used without permission in the song ‘Rang De Lal (Oye Oye)’ from the film ‘Dhurandhar 2’. Trimurti Films claimed that it owned the rights to the song and using it without license was a copyright violation. The company also objected to the commercial use of the song in the film’s theatrical release, digital platforms and promotional content. ‘Tirchi Topiwale’ was mainly shot on Naseeruddin Shah and Sonam. The music of the song was composed by Kalyanji-Anandji. It was sung by Amit Kumar and Sapna Mukherjee and its lyrics were written by Anand Bakshi. Whereas, the new version ‘Rang De Lal (Oye Oye)’ has been voiced by Jasmine Sandlas, Afsana Khan, Amit Kumar and Rebel. Its music has been composed by Shashwat Sachdev and Kalyanji-Anandji have also been given credit in the song.
