The Karnataka High Court on Thursday made very strict remarks regarding the Nandi Infrastructure Corridor Enterprise (NICE) project. The Bengaluru-Mysore Infrastructure Corridor Project (BMICP), implemented by Nandi Infrastructure Corridor Enterprise (NICE), has been described by the Karnataka High Court as “one of the biggest scams” in the state. The court has rejected the appeals of NICE and Karnataka Industrial Areas Development (KIADB) challenging the order canceling the land acquisition due to the long delay in determining the compensation to the farmers. The court says that the first order was correct.

Justice D.K. Singh and T.M. The NAAF bench has said that the state has failed to fulfill its constitutional responsibility. He allowed his personal interests to flourish and deprived thousands of land owners of their compensation and livelihood.

The bench has commented that ‘there is nothing NICE (good) in the NICE project’, and also said that the promoters were more interested in it than the farmers. About 20,193 acres of land was acquired for this project but even after 23 years no decision has been taken regarding compensation. The court reiterated that payment of compensation is a constitutional obligation under Article 300A.

Only 5 km portion of expressway was completed in 26 years

In this project, there was a plan to build 111 kilometers of expressway, peripheral and link roads, and five self-reliant townships but till now it has not been completed. Referring to the state’s affidavit, the court said that only 5 km of the proposed expressway was completed in approximately 26 years. The court also took cognizance of the fact that some parts of the acquired land were used for commercial transactions and private development agreements. The court termed it as “fraud on the law and the Constitution”. The court says that there should be an independent investigation in this matter and a forensic audit of the accounts of NICE.

The Division Bench upheld its previous order quashing the acquisition proceedings involving the affected land owners. With this decision of the court, there was a big relief to those farmers whose land was stuck for decades.
