A bench of Justices BV Nagarathna and Ujjal Bhuyan said forcing a woman, especially a minor, to carry a pregnancy to full term against her will would cause mental, emotional and physical injury.Rejecting the suggestion that the girl child should be allowed to give birth and adopt the newborn child, the bench said that the choice of the pregnant woman is more important. “This cannot be considered particularly in cases where the birth of the child is unwanted. In such a situation, ordering a pregnant woman to give birth against her will and hence continue her pregnancy would deny the welfare of the pregnant woman and subjugate the still-born child,” the Supreme Court bench said.
