After the victory in the Assam Assembly elections, Chief Minister Himanta Biswa Sarma has started working on the further agenda. CM Himanta Biswa Sarma has announced the introduction of Uniform Civil Code (UCC) in the state. He said that the Assam Cabinet on Wednesday has approved the implementation of UCC in the state. The UCC bill will be introduced in the new assembly on May 26.
The state government has decided to keep the tribal people out of the scope of this bill.
Chief Minister Himanta Sarma, after chairing the first cabinet meeting of his second term as head of the government, said at a press conference here that the draft UCC bill will be presented in the Assembly on May 26.
UCC will cover mainly four subjects.
1. Minimum age of marriage
2. Ban on polygamy
3. Equal rights for daughters in parents’ property
4. Matters related to live-in relationships
CM Himanta Biswa Sarma “This is a major decision taken in the first cabinet meeting and it is in line with the promise we had made during the elections,” he said.
Let us tell you that Uttarakhand, Goa and Gujarat have already implemented UCC, the Assam government has adapted it according to the needs of Assam.
He said, “We have completely kept the tribal population out of the scope of the UCC. All the customs, traditions and rituals that the people of Assam follow are out of the scope of the UCC.”
He further said that the UCC will include matters related to inheritance, marriage, live-in relationships and mandatory registration of marriage and divorce.
The new government of Assam has not made the draft of this bill public, but the government says that the bill will be in accordance with the constitutional provisions.
Sarma said that this law will create a uniform set of rules for all residents except Scheduled Tribes and tribal communities. It will also replace religion-based separate personal laws with a common legal framework to ensure equality and transparency, define key legal terms, and recognize diverse customs and modern family structures.
The Chief Minister also clarified that religious practices and rituals related to marriage will not come under the purview of UCC. He said the purpose of the proposed UCC law is to create a uniform system in civil matters, and not to affect the cultural identity of any community.
Himanta has given strict statement on child marriage and polygamy
CM Himanta Biswa Sarma has already shown a strict stance on issues like child marriage, polygamy. He has appealed to the Bengali-speaking Muslim community to give up child marriage and polygamy. He had said that he cannot keep two-three wives. This is not Assamese culture. CM has been continuously saying that he will have to give up the practice of child marriage and polygamy.
Let us tell you that Uttarakhand was the first state in India where UCC was implemented. After this, Gujarat Assembly has also passed this bill.
BJP’s ideological stance on UCC
When BJP talks about implementing UCC in the country, it means that laws related to marriage, divorce, inheritance, adoption and property should be the same for all citizens across India, irrespective of their religion.
BJP has an ideological stand on the Uniform Civil Code (UCC). It is based on Article 44 of the Constitution, which directs the State to endeavor to ensure a uniform civil code for the citizens throughout India. BJP believes that the principle of one nation-one law should be implemented in the country.
BJP believes that separate religious personal laws hinder national unity and promote discrimination against women in some communities. Through UCC, practices like polygamy and unequal inheritance will be abolished and all citizens will be given equal rights on the basis of gender and religion.
Implementing Uniform Civil Code has been a part of the BJP’s manifesto for years. In the 2024 manifesto, BJP had said, “There cannot be gender equality until India adopts a Uniform Civil Code.”
BJP first wanted to implement it in the entire country by making a law in the Parliament. But after opposition from NDA allies, opposition’s objection, civil society and tribal groups’ resentment, the party is implementing it state-wise.
In this regard, Assam is the third state where the government has taken steps forward on UCC.
