Supreme Court The Gwalior bench of the Madhya Pradesh High Court on Thursday stayed a judgment that annulled Congress MLA Mukesh Malhotra’s victory in the 2024 bypolls, Suchandana Gupta reported.
The High Court annulled the assembly by-election results on a plea by Malhotra’s closest rival, BJP’s Ram Niwas Rawat, claiming that the former had not disclosed criminal cases against him in his poll affidavit.
Accepting the Congress’ plea challenging the High Court’s verdict, the SC upheld Malhotra’s status as an MLA from the Vijaypur constituency with conditions: he would not be allowed to vote during the RS polls, would not be able to participate in voting in the Assembly elections and would not be able to collect his salary and perquisites under the MLA or MLALADS funds. However, he will remain the MLA of Vijaypur until the SC gives its final verdict. TNN
