The Uttar Pradesh government has informed the Lucknow bench of the High Court that a dedicated Backward Classes Commission will be formed before the upcoming Panchayat elections in the state. The bench of Justice Rajan Rai and Justice Awadhesh Chaudhary was hearing this case.

In fact, a petition was filed in the High Court challenging the rights of the existing Backward Classes Commission. The government has now clarified that reservation of seats will be decided on the basis of the report of this dedicated commission. This step has been taken in compliance with the instructions of the Supreme Court, in which it has been made mandatory to have a dedicated commission before the local body elections.

Why was there a need for a dedicated commission?

The tenure of the existing OBC Commission in UP had ended in October 2025, which the government has extended till October 2026, but questions were raised that legally it did not have the powers of a dedicated commission. According to the petitioner’s lawyer Moti Lal Yadav, if the original tenure of three years of the Commission had not ended, then it could have conducted the survey of reservation. Now a new dedicated commission will conduct a ‘rapid survey’ of the backward people. Only through this survey the actual population of backward classes will be ascertained and reservation of seats will be implemented accordingly.

Reservation will be given on the basis of backward population

There are clear instructions from the Supreme Court that before any local body or Panchayat elections, it is necessary to have a Backward Classes Commission or a dedicated commission with a tenure of three years. Now this dedicated commission will be formed Uttar Pradesh Will conduct an in-depth survey so that the reservation process can be made transparent. It is clear from this decision that now the announcement of Panchayat election dates will be possible only after the final report of the dedicated commission comes. After this announcement of the government, the possibility of legal disputes regarding reservation in the election process has reduced.
