A big controversy has arisen in Mumbai over a political statement. Advocate Pankaj Kumar Mishra has given a complaint to Mumbai Police Commissioner demanding registration of FIR against SP spokesperson Rajkumar Bhati. It has been alleged in the complaint that Bhati has allegedly made inflammatory and derogatory statements against the Brahmin community. The debate regarding this matter has also intensified on social media.
The complaint states that the accused allegedly spread hatred by targeting a particular community on the basis of caste and religion. The complainant alleges that such statements can create tension and division in the society. He has called it a serious threat to law and order and social harmony. Immediate legal action has been demanded in the matter.
Advocate Pankaj Kumar Mishra has cited several sections of the Indian Justice Code i.e. BNS 2023 in his complaint. According to the complaint, the statements of the accused are likely to increase enmity between different communities and disturb social harmony. It was said in the complaint that this case falls under the category of cognizable crime. Therefore, the police should immediately register an FIR.
Sections 196(1) and 196(2) of BNS have been mentioned in the complaint. Under these sections, acts that spread enmity between different groups on the basis of religion, caste, language or community and harm social peace are considered crimes. The complainant says that the statements of the accused come under the purview of these sections. For this reason immediate action is necessary.
Apart from this, Section 197 of BNS has also been mentioned in the complaint. This section is related to allegations and statements that harm national unity. The complainant said that making alleged inflammatory statements against any community from a public platform can be considered against the social unity of the country. That is why police investigation has been said to be necessary.
Sections 299 and 302 of BNS have also been cited in the complaint. These sections include provisions related to hurting religious sentiments and intentionally hurting the sentiments of any class. The complainant says that the statement of the accused has hurt the sentiments of the Brahmin community. For this reason, legal action has been demanded.
Section 353 of BNS has also been mentioned in the case. Under this section, such statements which promote public unrest and disorder are considered a crime. The complaint claims that the statement of the accused may increase tension and communal polarization in the society. It has been described as a threat to public peace.
The complainant has also filed an allegation of defamation under section 356 of BNS. It has been said in the complaint that an attempt has been made to harm the image of the entire Brahmin community by the alleged statement. Public comment against any community can give a wrong message to the society. Action has been demanded on this basis.
Information Technology Act i.e. IT Act 2000 has also been mentioned in the complaint. The complainant has demanded that the alleged objectionable content present on the social media platform be removed immediately. Besides, a demand has also been made to block access to such content. He says that online dissemination may further escalate the dispute.
According to the complainant, the accused is a sitting MLA and political spokesperson. In such a situation, his statement can have a greater impact on the common people. It has been said in the complaint that it is the responsibility of a person holding public office to maintain peace in the society. Therefore the seriousness of the matter increases further.
It has also been said in the complaint that alleged videos and statements are being continuously shared on social media. Due to this, resentment and anger is increasing among the people of Brahmin community. The complainant claims that if action is not taken in time, it may further increase communal tension. Therefore, a demand has been made to take immediate preventive steps.
Advocate Pankaj Kumar Mishra has demanded from the police that an impartial and timely investigation should be initiated under the Indian Civil Defense Code 2023 and IT Act. It has been said in the complaint that according to the law, appropriate punitive action should be taken by registering an FIR. At present, there has been no official response from the police in this matter.
