The Ministry of Home Affairs (MHA) has taken an important step towards modernizing the administrative and regulatory framework of the Union Territory of Chandigarh. In a historic decision, the Central Government has extended five key laws of the neighboring states to Chandigarh using Section 87 of the Punjab Reorganization Act, 1966.

The primary objective of these reforms is to promote ‘Ease of Living’ and ‘Ease of Doing Business’ in the city, which will bring an end to outdated and irrelevant legal provisions that have been in place for years. The most prominent of these changes is the adoption of the ‘Assam Tenancy Act, 2021’, which has replaced the pre-independence law of 1949. Now Chandigarh Rent agreements will be mandatory and tenants will get security of basic facilities like electricity and water, which the landlord will not be able to disconnect in case of any dispute. This new framework is not only transparent, but also promises time-bound resolution of disputes.

This string of administrative reforms is not limited to just tenancy, but also touches other important aspects of security and transparency. ‘Punjab Prevention of Human Trafficking Act’ has now come into force in Chandigarh, which will specifically crack down on ‘dinky routes’ and fraudulent travel agents who dupe youth in the name of sending them abroad. Also, on the recommendation of Chandigarh Municipal Corporation, ‘Haryana Fire and Emergency Services Act, 2022’ has been adopted by removing the old Delhi Fire Safety Rules of 1986.

This will simplify the process of obtaining fire NOC for hospitals and high-rise buildings and improve safety standards. Additionally, stamp duty laws have been amended to ensure proper valuation of property and new land record laws have been implemented to formalize ownership of rural areas. Collectively, all these measures will lay the new foundation of an accountable, modern and citizen-centric governance in Chandigarh.
