Allahabad High Court has rejected the administrative order to limit the number of people offering Namaz in a mosque in Sambhal district of Uttar Pradesh. The matter was heard on a petition filed by Munajir Khan, a resident of Sambhal, in which he alleged that he was prevented from offering Namaz at Gata No. 291 during Ramzan. According to the petitioner, a mosque is present at the said place and people should be allowed to offer Namaz here.
The state government said in its argument that in view of the law and order situation, the number of worshipers was limited and only 20 people were allowed to offer namaz.
The petitioner’s argument was that a large number of people come to offer Namaz in the month of Ramzan, hence it is unfair to restrict this number. The state government also informed that in the revenue records the name of Gata number 291 is registered in the name of Mohan Singh and Bhojraj Singh.
The division bench of the Allahabad High Court, comprising Justice Atul Sridharan and Justice Siddharth Nandan, said during the hearing that it is the responsibility of the state to ensure compliance with the law. If the administration feels that he is not capable of maintaining law and order, he should either resign from his post or be careful Should demand transfer out of.
The court also made it clear that if the worship is taking place on a private property, then it is not necessary to take permission from the state government. The court has scheduled the next hearing of the case on March 16. This decision made it clear that unreasonable restrictions will not be imposed on religious activities and the administration will have to take a balanced decision.
